  1. ABOUT THIS POLICY
    1. This Privacy Policy (Policy) applies to Sydney Philharmonia Limited ACN 001 253 256),  (“Sydney Philharmonia Choirs“, “we“, ”our” or “us“), and describes how Sydney Philharmonia Choirs collects, handles and protects the privacy of your personal information.
    2. Sydney Philharmonia Choirs is Australia’s largest choral organisation.  We promote choral music across all genres through performance, community engagement, commissioning and the support of professional and aspiring conductors, composers, singers and musicians.  We provide singing opportunities for thousands of dedicated amateur singers each year and support the professional music eco-system.
    3. We are committed to protecting your privacy and understand the importance of protecting your personal information.  This Policy outlines the types of personal information that we usually collect, the purposes for which we collect it, to whom we disclose it, and your rights in relation to your personal information, including how to complain and how we deal with complaints..
    4. In this Policy, personal information means any information or opinion about an identified individual or an individual who is reasonably identifiable, whether true or not.  It does not include information that is de-identified.
    5. This Policy does not apply to the personal information of our employees.
    6. We may change this Privacy Policy from time to time, by publishing changes on our website.
  2. TYPES OF PERSONAL INFORMATION WE COLLECT
    1. The types of personal information we collect about you depends on the dealings you have with us.
    2. We will collect details of your interactions with us, and often collect your name and contact details (such as your address, email address and/or telephone number).
    3. When you sing with us, we may also collect information about:
      1. your gender;
      2. your vocal part;
      3. your audition results (in connection with our auditioned choirs);
      4. your date of birth;
      5. your interests and preferences, including whether you wish to remain in touch with us through alumni and friends programs if you are no longer able to be a performing member of the company;
      6. health information, including in respect of special requirements that may be required to ensure your participation in rehearsals and performances, or information concerning medical absences from rehearsals or performances.
    4. If you are an audience member or supporter of our organisation, we may collect:
      1. your name, address, email address and telephone number;
      2. your gender and professional title;
      3. your date of birth (if purchasing U/30 or concession tickets);
      4. payment details, such as credit card details; and
      5. details of your interactions with us, including ticket purchase and donation history.
    5. If you are applying for a job with us, engaged as a contractor or applying to be a member of our board, where relevant we may also collect your:
      1. employment history and qualifications;
      2. tax file number;
      3. academic records;
      4. references;
      5. medical information;
      6. personal alternative contact details;
      7. superannuation fund details;
      8. criminal history record; and
      9. insurance details.
  3. DEALING WITH US ANONYMOUSLY OR USING A PSEUDONYM
    1. Where possible and lawful, you may interact with us anonymously or using a pseudonym.  For example, if you contact us with a general question we will not record your name unless we need it to adequately handle your question.  You may also wish to make a donation on an anonymous basis.
    2. However, for many of our functions and activities we usually need your name, contact information and other details to enable us to provide our services or products to you.
  4. WAYS WE COLLECT YOUR PERSONAL INFORMATION
    1. We may collect personal information from or about you in different ways, including:
      1. from you directly when you interact with us, eg from our discussions with you, when you complete a form, your emails and your interactions with our website;
      2. through third parties with whom we interact in order to provide our services, such as platforms like Choir Genius and Tessitura; and
      3. publicly available sources, including social media.
    2. If you apply for a job or contract position with us, we may also collect personal information about you from third parties and publicly available sources, including:
      1. recruiters;
      2. government departments to verify your entitlement to work in Australia;
      3. police agencies to obtain your criminal history record;
      4. academic institutions;
      5. consulting medical practitioner;
      6. superannuation fund provider;
      7. your current or previous employers; or
      8. your referees.
  5. PURPOSES FOR WHICH WE COLLECT, USE AND DISCLOSE PERSONAL INFORMATION
    1. We collect your personal information for the following purposes:
      1. to maintain our register of members;
      2. to administer our choirs and organise concerts and performances;
      3. to manage and conduct our business;
      4. To run events for our donors, members, board, audiences, alumni and friends;
      5. to offer or promote our products and services, including our concerts and performances;
      6. to obtain feedback;
      7. to help us manage, develop and enhance our services, including our websites and applications;
      8. to consider your suitability for employment; and
      9. to comply with our legal obligations, resolve any disputes and enforce our agreements and rights with third parties.
  6. DISCLOSING YOUR PERSONAL INFORMATION
    1. In the course of our dealings with you, we may disclose your personal information in the following circumstances:
      1. In our publications such as programs for performances where you are a performer or donor;
      2. To third parties in order to provide our services, for example to the Sydney Opera House and other performance or rehearsal venues where we are required to identify who will be on the premises;
      3. To organisations we contract to provide services on our behalf such as software suppliers like Choir Genius;
      4. To our professional advisers, including lawyers, accountants and auditors; and
      5. To government agencies, regulatory bodies and law enforcement agencies, or other similar entities.
    2. Some of these organisations may be located in or utilise servers that are located overseas, including in the United States of America and Canada.
    3. Our customer relationship database, Tessitura is shared with the Sydney Opera House and other similar Australian arts organisations for the purpose of ticketing, marketing, fundraising and customer relationship management.

      The other organisations that currently participate in the shared database are the Australian Chamber Orchestra, Australian Museum, Bangarra Dance Theatre, Bell Shakespeare Company, Museum of History NSW, Opera Australia, Sydney International Piano Competition and Sydney Opera House.

      These other organisations are able to view and access your name and address when you engage in a transaction with us.  We can also view such information when you provide it to any of the other participating organisations (listed below).  This is so we can each process your transactions as effectively as possible without asking you to repeatedly provide the same information, and also helps ensure the speed and efficiency of any of your dealings with us and the other organisations.

      These organisations are only permitted to use the information they can access in the database for the purpose of processing your transactions when you engage with their websites.  They are not permitted to use the information for their own marketing purposes (unless you have a separate relationship with the organisation, that permits them to do so).
  7. DIRECT MARKETING
    1. We may use your personal information to identify concerts and performances that you may be interested in or to contact you about events, donation campaigns and opportunities to sing or perform with us.  We may, with your consent, use the personal information we have collected about you to contact you from time to time whether by telephone, email or mail to tell you about new concerts, performances, events, donation campaigns, opportunities and special offers that we believe may be of interest to you.
    2. You can withdraw your consent to receiving direct marketing communications from us at any time by unsubscribing from the mailing list by clicking on the link in the marketing communication or contacting the Privacy Officer.
  8. ACCESS TO AND CORRECTION OF YOUR INFORMATION
    1. We will endeavour to ensure that the personal information collected from you is up to date, accurate and complete.
    2. You may request access to, or correction of, the personal information we hold about you at any time by contacting the Privacy Officer.  We will need to verify your identity before responding to your request.  Subject to any applicable exceptions or requirements, we will provide you with access to the personal information you request within a reasonable time and usually within 28 days.  If we decide to refuse your request, we will tell you why in writing and how to complain.
  9. COMPLAINTS
    1. You can make a complaint in writing to our Privacy Officer using the details set out in this Policy.  We will respond to you within a reasonable period of time to acknowledge your complaint and inform you of the next steps we will take in dealing with your complaint.
    2. If you are not satisfied with our response, you may complain to the Office of the Australian Information Commissioner (OAIC) via the OAIC website, www.oaic.gov.au.
